Harnish Group Inc. and its member companies, including N C Machinery, N C Power Systems, and N C Machinery Cat Rentals (collectively, “Harnish Group,” “we,” “our,” or “us”), provide this Privacy Policy to assist you in understanding how we collect, use, disclose, and otherwise process information about you. 

This Privacy Policy applies to individuals who access our websites and our mobile applications  (collectively, “Sites”) and the services and other online products provided through our Sites (collectively, “Services”). This Privacy Policy also applies to individuals who purchase or rent machines, equipment, or products (“Assets”), sign service agreements, submit credit applications and other business documents, or who interact with us at trade shows, contact our customer service team, visit one of our locations (“Contact Centers”), or otherwise interact with us.

From time to time, we may change this Privacy Policy. If we do, we will post an amended version on this webpage and notify you by revising the date at the top. If we make material changes, we will provide you with additional notice (such as by sending you a notification). Please review this Privacy Policy periodically. The information we collect about you depends on how you interact with us. In this section, we describe the categories of information we collect and the sources of this information.

Information You Provide Directly to Us

We collect information that you voluntarily provide to us. For example, we collect information directly from you when you request a quote or service, rent equipment, create an account, apply for financing, make a purchase, respond to surveys, or otherwise communicate with us. The types of information that we collect directly from you include your name, email address, phone number, physical address, zip code, financing-related information (which may include social security number), and any other information you choose to provide. If you make a purchase from us, we work with a third-party payment processor to process your payment information.

Information We Collect Automatically

We automatically collect certain information when you use the Sites and Services or visit one of our Contact Centers, including:

  • Device, Usage, and Activity Information. We collect information about the pages on the Sites you access, the frequency of access, the sources of entry to the Sites, what you click on while on the Sites, and whether the Site is accessed via a mobile device or tablet, the device type, and the carrier. Also, we collect information about your device such as the hardware model, operating system, application version number, and browser.
  • Location Information. Location information from visitors’ devices when visiting the Sites, on a city-regional basis.
  • Audio and Video Recordings and Photos. We capture photographs and video recordings on our locations for security and loss-prevention purposes. If you contact customer service by phone, we may monitor and retain those conversations, including for training purposes.
  • Information Collected by Cookies and Similar Tracking Technologies. We use tracking technologies, such as cookies, pixels, web beacons, SDKs, to collect information about your interactions with our Sites and Services and our marketing communications. These technologies help us improve our Sites and Services and marketing communications, personalize your experience, and analyze your interactions with us, including to see which areas and features of our Sites and Services are popular and count visits. Systems Data

We may collect the following information through your use of web applications (including, but not limited to, VisionLink, ProductLink, and similar applications) and telematics and similar devices (“Devices”) (collectively, “Digital Offerings”). This information includes electronic data, inspection data, device location information (e.g., determined using satellite, GPS, cell phone tower, Bluetooth, or Wi-Fi signals), fluid data, event records, service and maintenance history, warranty coverage data, site and environmental conditions, patterns of use, and information relating to pre-installed/installed applications/Devices and from wearable technologies (e.g., fatigue monitoring and RFID tags in safety equipment).

Operations Data

We may collect the information through our operations. For example, we collect information from you when you engage in a business relationship with us, including when you make a purchase, submit a work order, or make a payment. The information we collect may include information relating to clients (including names, addresses, industries, and parts or machine purchases, returns, or replacements), information about machines, equipment, or products (“Assets”), payment information, billing address, and other information you may provide in connection with the foregoing.

Information from Third-Party Sources

We may collect the following types of information from publicly and commercially available sources as permitted by law, which we may combine with other information we receive from you.

  • Caterpillar Account. Certain website functions are provided through a Caterpillar Inc. (“Caterpillar”) account. To create a Caterpillar account, you will provide your email address, name, phone number, password, and postal address. Caterpillar shares this information with us if you choose to use a credit application as a joint application for credit with Caterpillar and us. You can find Caterpillar’s privacy policy here.
  • Via Caterpillar or its business affiliates or contractors. We may receive information from Caterpillar or its business affiliates or contractors that have collected information from you via: (i) cellular or satellite link, or radio or Ethernet connection from Assets, which may include System Data (such as information relating to the Device or Asset) or personal information (such as from information generated by fatigue monitoring Devices, on-board camera and proximity detection systems, and in-cab monitoring technology); or (ii) Digital Offerings.
  • From Asset Owners and Others. We may receive additional information about an Asset from Asset owners, operators, and other persons who have management responsibility for an Asset.
  • From Other Sources. We may receive your information from other sources, such as credit reference agencies, public databases, joint marketing partners, social media platforms (including from people with whom you are friends or otherwise connected), and from other third parties. We may collect or generate information about Assets from troubleshooting data, from your service providers (such as fluid analysts and site inspectors), or from maintenance, inspection or warranty records.

 

  1. How We Use Your Information

We use the information we collect to provide, maintain, improve, and personalize our products and services, including our Sites and Services. In addition, we may use the information we collect to:

  • Manage your account and administer our relationship with you;
  • Process and fulfill your orders;
  • Fulfill client value agreements;
  • Perform maintenance and repairs;
  • Enhance the safety of machine operations and make recommendations regarding safety, Asset health, maintenance, worksite efficiency, and productivity training for operators;
  • Send you technical notices, security alerts, support messages, and other transactional or relationship messages;
  • Send you marketing communications (see the Choices About Your Information section below for information about how to opt out of these communications at any time);
  • Respond to comments, questions, and requests, and provide support and customer service;
  • Conduct market research, perform data analytics, enhance our products and services, and develop new offerings;
  • Allow you to participate in sweepstakes, competitions, or similar promotions and to administer these activities;
  • Detect, investigate, respond to, prosecute, and help protect against security incidents and other malicious, deceptive, fraudulent, or illegal activities, and help protect the rights and property of Harnish Group and others;
  • Comply with our legal and financial obligations; and
  • Create de-identified or aggregate information that cannot reasonably be linked to you.

We may share the information that we collect about you as described in the Targeted Advertising and Analytics section below and in the following ways:

  • With our parent, subsidiary and affiliated entities;
  • With contractors, service providers, manufacturers, and other third parties used to support our business and the business of our manufacturers, including  vendors who perform services on our behalf (e.g., email, hosting, maintenance, backup, analytics, customer service, fraud prevention, marketing, and payment processing);
  • With law enforcement authorities and individuals involved in legal proceedings in response to a request for information if we believe that disclosure is in accordance with, or required by any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
  • If we believe that your actions are inconsistent with our agreements or policies, if we believe you have violated the law, or we believe it is necessary to protect the rights, property, and safety of Harnish Group and our users, the public, or others;
  • With any other person or entity as part of any business or asset sale, equity transaction, merger, acquisition, or financing of all or a portion of our business; bankruptcy, liquidation, or similar proceeding; or in preparation for any of these events;
  • With our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business.
  • With any other person or entity where you consent to the disclosure; and
  • For any other purpose disclosed by us when you provide the personal information.
  • With Caterpillar Inc. and its subsidiaries. Certain customer account information and sales data is shared with Caterpillar.   1. Targeted Advertising and Analytics

We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile applications. To do this, Harnish Group and these partners may use cookies, pixels, SDKs, and similar technologies to collect information about your use of our Sites and Services and other websites and mobile apps, including your device identifiers, IP address, web browser and mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, order information, items added to cart, and conversion information. This information is used to deliver advertising targeted to you on other companies’ websites and mobile apps, understand the effectiveness of this advertising, analyze and track data, determine the popularity of certain content, and better understand your activity.

In addition to ad targeting activities that rely on cookies and similar technologies, we work with advertising partners to translate other identifiers, such as your email address or phone number, into a unique identifier (called a hashed value) that such partners can then use to show ads that promote Harnish Group that are more relevant to you across the web and in mobile apps.
